Software volume contract

The completion of a software volume contract is part of everyday commercial and legal working life of software producers or traders on the one hand and medium-sized or large companies on the other hand.

Without question, a major part of the software business is made in the b-2-b area by sales of large quantities by large volume contracts, which consequently result in high discounts.

The resale of no longer required used software licensing brings up the following question whether also individual licences from the package can be resold or whether also volume contracts with a smaller quantity of licences can be newly completed.

According to the opinion of the copyright experts and of course also usedSoft it is permitted that also partial stock of licences can be resold, even also an individual licence because also in cases of volume licence contracts individual items can be resold, which are no longer subject to the right of distribution of the trader as it is exhausted. The sale of several volume licenses by means of a volume contract is rather more to be seen as a special discount of the producer, which is solely intended to secure a further distribution channel. In this way also this could result in new volume contracts with changed licence quantities.
