Registration Liability of Software Purchases

Buyers of software are usually asked via online-forms or e-mail-follow-ups to register their purchased product at the producer. Very often the reasons for this are supposed to be the resulting or improved support possibilities and eventual update options. The private data involved in this process in connection with product specific data is not in the interest of all buyers.

Liabilities of registration cannot lead to a limitation of the legal exhaustion effect. Therefore, the resale of software cannot be restricted because of a contractually effective duty of registration. A right of veto in favour of the producer in case of a resale of software is basically ineffective.
