COMPUTERWOCHE ONLINE: MICROSOFT BACKS DOWN IN LAWSUIT AGAINST STUDENTThe lawsuit between Microsoft and a university student from the U.S. - the magazine Computerwoche reportet on its website on 15-03-2005 - closed with an abdication of the case and a secrecy declaration. Microsoft initially filed an action against the yougn man, as he had sold two unused university licences on ebay with profits. The student countersued on the grounds that in doing so he had not infringed upon licence rights. Microsoft thereupon put down the lawsuit, and also the student abandoned his claim. Obviously this happend due to an agreement with Microsoft, based on which the student had to commit himself to maintain absolute secrecy.

RT – RETAIL TECHNOLOGY: "WHO IS LIABLE FOR NETWORK ATTACKS?""Who is liable for network attacks?" This is what "rt – retail technology" wants to know in its edition from 5/2005. On the occasion of the CIO congress held by usedSoft and F-Secure, the magazine throws light on liablilty risks for IT-responsibles – and the possibilities to protect themselves against it. The renowned attorney-at-law and specialist in IT Law Wilfried Reiners recommends to stringently ban private surfing and mailing as an action against trojans, viruses etc. Insufficient provision with necessary software licences brings another high legal risk for enterprises. If this extent of underlicensing gets to the attention of the Public Prosecutor's Office, the latter cannot take any optional steps but is forced to confiscate the server. "retail technology" refers to the purchase of used software licences as a legitimate instrument to counter the described risk.
