USEDSOFT IS EXPANDING ITS INTERNATIONAL SALES
usedSoft continues to expand its international sales. For this purpose, Stefan Suter takes over the new position of Sales Director for Northern and Southern Europe. Suter will be responsible for the countries Italy, Spain, France and Portugal, as well as for Finland, Sweden, Norway and Denmark.

THE JUDGMENT RENDERED BY THE HIGHER REGIONAL COURT OF DÜSSELDORF DOES NOT APPLY TO MICROSOFT SOFTWARE
The decision passed by the Higher Regional Court of Düsseldorf on June 29, 2009, explicitely applies to the trade with used licences of a special software for lawyers and not to Microsoft licences. According to existing law, judgments are always only effective for the parties of a litigation, and they do not have any legal impact on other market participants. Moreover, usedSoft will lodge an appeal against such judgment. In the principal proceedings the lawsuit will be retransferred to the Regional Court of Düsseldorf which had rendered a decision in favour of usedSoft in the first instance, thereby ensuring a scrutinized review of the factual and legal issues involved.

THE TRADE WITH MICROSOFT OEM-LICENCES IS NOT AFFECTED BY THE JUDGMENT RENDERED BY THE HIGHER REGIONAL COURT OF DÜSSELDORF
The decision about OEM-licences passed by the Higher Regional Court of Düsseldorf on June 29, 2009, exclusively applies to the OEM-licences of a special software for lawyers. At any rate, the judgment does not apply to any OEM-licences in general. In particular, Microsoft has never contested the resale of OEM-licences of his own trademark. And, individual software licences originating from Microsoft volume licence contracts may be resold second-hand due to the clear decisions passed by the Regional Courts of Munich and Hamburg.

Vera Heubel has become marketing director of usedSoft. In future, all marketing activities of usedSoft will be under the combined control of this IT- and marketing specialist. In view of the strong international expansion, she will be particularly responsible for the development of a well-functioning international marketing organisation.
