PRESS INFO: USEDSOFT IS STRONGLY GROWING
In the year 2007 usedSoft has been strongly growing again. This year's sales will be more than doubled. After having achieved sales in the amount of 4.1 million Euro in the year 2006, usedSoft has sold used software valued at almost 10 million Euro this year. According to a recent analysis of the market research institute Experton Group, the company usedSoft with its market share of about 50 percent is the unchallenged market leader on the German used software market.

The whole industry is disappointed of Windows Vista?, complains Gianfranco Lanci, President of Acer, towards Financial Times Deutschland. It never happened before that a new version of Windows has stimulated the sales of computers to such a low extent. I really believe that there will hardly by any person buying a new pc because of Vista.? In particular, there would be many business customers asking them to install the old system software Windows XP. However, this old system software is no longer offered by Microsoft itself. Therefore, companies being in need of new software are confronted with a real dilemma. A solution may be found on the used software market. The company usedSoft has permanently ten thousands of -XP Professional-licences in stocks and it sells them with a price benefit of up to 50 percent compared with the new price.

PRESS INFO: ORACLE LOST AGAINST USEDSOFT BEFORE COURT
Oracle attempt to prohibit usedSoft from selling "used" Oracle-software on data carriers has failed. The Regional Court of Munich I dismissed a corresponding motion for regulatory means submitted by the company Oracle (file no. 7 O 23237/05). Oracle unsuccessfully pleaded that the sale of "used" Oracle software on data carriers would constitute a violation of the provisional injunction issued on January 2006. By dismissing the recent motion submitted by Oracle, the court declared again that the (re-)sale of software on data carriers had not been subject of the former proceedings. This clarification is of great importance, as the saleable standard software products including Microsoft, Adobe and SAP are exclusively stored on data carriers when offered for sale.

PRESS INFO: MICROSOFT IS AGAIN DEFEATED BY USEDSOFT
Microsoft's attempt to criminalize the trade with "used" software has failed again. The Munich Chief Department of Public Prosecution dismissed a complaint against the dismissal of the criminal proceedings against usedSoft without any restrictions which had been lodged by the software monopolist. Thus, Microsoft's repeatadly uttered reproach that the trade with used software through the company usedSoft would be the same as dissemination of pirate copies has now been finally disproven. After such dismissal of Microsoft's complaint, Microsoft obviously admitted its defeat as it waived its right to any further appeal. The dismissal of the criminal proceedings has therefore become final and absolute.

PRESS INFO: REGIONAL COURT OF MUNICH CONFIRMS THE PROVISIONAL INJUNCTION IN THE MATTER OF ORACLE VERSUS USEDSOFT
The judgment rendered by the Regional Court of Munich only applies to Oracle software, and it only applies if it has been assigned online. Actually, there are only very few software developer offering software for sale online. Any saleable standard software products including Microsoft, Adobe and SAP are sold on data carriers, and thus they continue to be freely marketable.
