According to the affirmative judgement of the Hamburg Regional Court, trading with of "used" software licences is fully legitimate. This is also applicable to the resale of singular licences out of a volume licence contract.

PRESSEINFO: DEALING WITH USED SOFTWARE REMAINS LEGAL
According as well to the judgement of the Munich Higher Regional Court (OLG) of August 3, 2006, the resale of used software remains legal. The court decision is applicable exclusively to software of the company Oracle, and only if it has been acquired per internet download. However, from this day on companies must insist on a CD when purchasing software!
