The discussion about the trade and the sale of used software licenses is going to develop into an economic leading debate within the forthcoming years.
By means of the verdict of the Federal Court of Justice Munich of 3. August 2006 it has been temporarily stated that in case of software only exclusively or in mainly being available via downloads (as in the case of the software producer Oracle) the exhaustion rule is not applicable i.e. in this case overstretched. On the other hand there are no real hints about an interpretation, which clearly define a fundamental prohibition of the trade with used software licenses.
Clients of the company usedSoft as well as well-known buyers of renowned industrial companies have repeatedly made clear how important an insisting strengthening of the freedom of availability about their property is to them. Some people also believe that an enforced legal strengthening of the trade with used software license is a long overdue correction possibility for exorbitant software prices during the last decades.
