"Completely absurd": These clear words were found by the "Wirtschaftswoche", when commenting on the idea that a car manufacturer would forbid the resale of used cars. Why should it be different regarding software? Meanwhile, more and more companies are benefiting from the market for used software - and the sales continue to grow: "In the medium term (...) experts are forecasting a tenfold increase". This great popularity does not only result from the savings potential of up to 50%, but also from the fact that the second-hand market provides for the only possibility to buy older software versions which have already been removed from the market by the developers. Moreover, buyers do not need to worry about any legal risks:"Although Microsoft is really "not amused", the software giant cannot do anything against it under legal aspects: Based on a judgment rendered by the Regional Court of Munich, the sale of individual licences originating from volume contracts is also possible without the developer's consent."

The Austrian computer trade magazine e-media makes the appeal: "Buy used software now!" - In doing so, you do not only save money when buying software, but you also get programs which are not available as new programs anymore. The software second-hand market is a thrilling field: in particular, the market leader usedSoft with its innovative business model keeps the software giants globally on the go, reports the entrepreneurs' magazine "Drive".Due to the sale of used licences for Windows XP and Co. by the pioneer usedSoft, the market for used software became finally acceptable. Such efforts are rewarded: Since 2004 we have doubled our sales volume every year - in 2007, it amounted to 8.5 million Euro", says the managing director Peter Schneider during an interview. The business is still growing, while the number of customers has increased to 700 in almost all EU-countries. usedSoft is already respresented In Switzerland and Austria, now followed by branches in Italy and Spain.

THE SCHMITT-LETTER: "USED SOFTWARE LICENCES"

Under legal aspects, the trade with used program-licences is not objectionable", reports the renowned Schmitt-letter in his June 20 - issue. As a result, licences may be generally resold. According to expert opinions, more than 40 percent of the software licences remain unused by the companies, emphasizes the editorial office: Instead of letting them get dusty, more and more companies are now opting for the software second-hand market in order to turn such licences into liquid funds. And even when purchasing software, the second-hand market is sought-after: It does not only provide saving opportunities of up to 50 percent, but also licences which are no longer available on the regular retail market."

KOMMUNALINFO: "USED SOFTWARE - AUTHORITIES AT ECONOMY DRIVE"

The public administration has also discovered the buying of "used" software for its purposes, reports the magazine Kommunalinfo 24 in its edition of May 2008. The leading used software supplier usedSoft has noticed an increased demand from German authorities. Thus, the Bavarian State Capital of Munich achieved savings of more than 50 percent compared with the new price when buying 2,000 "used" Microsoft licences. More and more authorities are now following this trend and are also opting for usedSoft licences. In doing so, the municipality of Neckarsulm could save costs of 60 percent. "We feel being obligated to manage public funds in a cost-saving way. Therefore, the possibility to buy used software has immediately arisen our interest", emphasizes Detlef Klein of the municipality of Neckarsulm. In the end, the increasing demand for "used" licences is explained by the positive development of the legal situation. Under legal aspects, the trade with used software has been generally accepted in the meantime.

COMPUTERWOCHE: "WHAT THE SECOND-HAND MARKET OFFERS"

Numerous studies have shown that a major part of all German companies are fitted with licences in a wrong way. On the one hand, there is software often used regarding which no sufficient licence rights have been acquired, on the other hand there are licences which are gathering dust as they are no longer used. The Computerwoche reports how the second-hand market for software may put things right in every respect: While making money out of a surplus of licences, companies may purchase missing licences afterwards, thereby making savings of up to 50 percent. And due to the fact that second-hand dealers are not obligated to inform the developers about their transactions at all, any additional purchase of used licences is winded up in a quick and silent way. Such handling does not only protect companies from legal consequences resulting from any under-licencing, but also from severe penalties often demanded by the software developers.

ZDnet: "THAT'S HOW COMPANIES ARE SAVING GOOD MONEY"

The internationally leading IT-trade service ZDnet recently analysed the situation and perspectives of the market for used software. Right in the heading it says: "That's how companies are saving good money". And the editor recapitulates that the legal security and the defects of the new Microsoft operating system Windows Vista have given wings to the market for used software - with usedSoft as clear market leader at the top.
